Terms & Conditions


  1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

  2. The promotion is only open to Australian residents. Employees and sub-contractors (and their immediate families) of the Promoter, Cricket Australia and their agencies associated with this promotion are ineligible. For the sake of clarity, sub-contractors include employment agency employees who are currently performing work for the Promoter and Cricket Australia.

  3. Promotion commences on 26/11/09 and closes at 11.59pm AEDST on 23/02/10 (“Promotional Period”).

  4. The promotion will be conducted at 19 selected cricket games in the 2009-2010 summer cricket series as detailed below:

  5. An “Eligible Shirt” means any official adidas licensed replica Australian Test, One Day International (Home or Away strip) or Twenty20 shirt from the years 2005, 2006, 2007, 2008, 2009 or 2010. At each of the above selected cricket matches the Promoter’s representative will randomly select a person wearing an Eligible Shirt from the crowd, during a break in the play on the first day in the case of a Test match, or the change of innings in the case of a One Day International or Twenty20 match. This person will be approached by the Promoter’s representative to confirm their eligibility to receive the prize and to take down their details. Once confirmed that they are eligible to take the prize, the person will be deemed a winner and receive the relevant prize. The winner will also be displayed on the “Big Screen” at the relevant match. There will be a total of 19 prizes to be won. One (1) prize for each of the above selected cricket matches.

  6. In the event that the first day of a selected Test match is cancelled, the prize for that test match will be awarded during a break in play on the following day, unless the subsequent day is cancelled, in which case it will be awarded on the following day. This process will continue until the relevant prize is awarded. In the event that the entire 5 days of a particular selected test match, or a selected One Day International or Twenty20 match, does not proceed, and a particular prize cannot be awarded in accordance with the above process, the unclaimed prize will be entered into the unclaimed prize draw.

  7. To enter the unclaimed prize draw, an eligible person (other than a resident of South Australia who is not permitted to enter) must, during the Promotional Period, send an email, with the subject title “Adidas Cricket Australia competition” to selina.bridge@iris-melbourne.com, with their full name, address, and home or mobile phone number. Incomplete or indecipherable entries will be deemed invalid.

  8. The draw to award any unclaimed prizes will be held at Anisimoff Legal, Suite 1, Level 1, 34 Chandos Street, St Leonards NSW 2065 at 3pm on 26.02.10, subject to any written direction from a regulatory authority. Winners, if any, will be notified by mail.

  9. All winners will receive confirmation in writing, either by a hand delivered letter or a letter delivered by mail. The names of the winners will be published online at www.adidascricket.com.au, and in the case of Victorian winners, if any, in The Australian on 11/12/09, 31/12/09, 14/01/10, 28/01/10, 11/02/10 and 4/03/10. Only selected Victorian winners will appear in each newspaper publication, which will depend upon when they won the prize.

  10. The Promoter’s decision is final and no correspondence will be entered into.

  11. The prizes that are available to be won are as stipulated below. Each prize is valued at $2,000. The prize to be awarded for each selected cricket match will correspond to the match being played. For example, an official Test Cricket shirt is available to be won at a selected test match.

    • 6 official Test cricket shirts signed by selected players from the 2009/10 Australia cricket test squad;

    • 10 official ODI (One Day International) shirts signed by selected players from the 2009/10 Australia cricket test squad; and

    • 3 official KFC Twenty20 International shirts signed by selected players from the 2009/10 Australia cricket test squad.

  12. The Promoter does not have any control over the signatures on the shirts and will not be held responsible for any player who does not sign the shirt.

  13. If for any reason a winner does not take a prize or an element of a prize at the time stipulated by the Promoter, then the prize or that element of the prize will be forfeited and not be redeemable for cash.

  14. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

  15. Total prize pool value is $38,000. Prizes are not transferable or exchangeable and cannot be taken as cash.

  16. It is a condition of accepting the prize that winners agree to the Promoter and Cricket Australia using the winners’ name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter or Cricket Australia.

  17. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

  18. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion, including, but not limited to, where arising out of the following:

    • any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);

    • any theft, unauthorised access or third party interference;

    • any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;

    • any variation in prize value to that stated in these Terms and Conditions;

    • any tax liability incurred by a winner or entrant; or

    • use of a prize.

    Where the law implies warranties which cannot be excluded, the Promoter's liability for breach of those warranties is limited to re-supplying the prize (or paying for the costs thereof), where this is permitted by law.

  19. As a condition of accepting a prize, the winners (or if under 18 years of age their parent or guardian) must sign a declaration confirming their eligibility to claim the prize.

  20. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Email entry or to claim a prize is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter. Subject to this paragraph, all personal information collected from entrants will be handled in accordance with the adidas Privacy Policy which can be accessed by visiting www.adidas.com/au.
